Can I get Legal Aid for my Immigration or Asylum Case?
Legal aid is government-funded support. To qualify, your case must be “in scope” and you must pass a financial “means test” and a “merits test”. As a firm contracted with the Legal Aid Agency, we provide free legal advice and representation to eligible individuals in specific types of immigration and asylum cases.
Not all applications are covered by Legal Aid, and some require applications for funding on an exceptional basis. Applications which are covered by Legal Aid include:
Standard visa applications, such as Spouse Visas, Work Visas or Student Visas are not usually covered by Legal Aid.
Financial Eligibility (Means Test)
To be eligible for Legal Aid, you will need to show that you do not have the financial resources to pay for legal assistance.
The government, through the Legal Aid Agency, set specific criteria for financial eligibility, which we will assess during your initial conversation with us. If you are in receipt of Asylum support, or certain other benefits, you will automatically meet the financial eligibility criteria.
Merits Test
The Legal Aid Agency requires us to show that your case has a reasonable chance of success. We will conduct this assessment during our initial advice consultation, or by review of your documents.
Exceptional Case Funding
If your case is considered to be “out of scope” (such as a Human Rights claim, or standard visa application), but you cannot afford a lawyer, you cannot apply without legal help and your human rights would be breached without one, we may be able to apply to the Legal Aid Agency for Exceptional Case Funding.
